Website Design Terms & Conditions
The following terms apply to all website design and development services provided by Gorham's Web Creations. By purchasing services, the client agrees to these terms and conditions.
Free Demo Website
Gorham's Web Creations may provide a free sample or demo website for preview purposes only. Demo websites are not considered final products and may not include all features, revisions, or final content until payment is received and the project is approved.
Deposits & Payments
A deposit or full payment may be required before beginning full website development or publishing the website live. Remaining balances are due upon project completion before the website is transferred, published, or fully released to the client.
Final Payment / No Refunds After Going Live
Once payment has been made to publish, launch, transfer, or make the website live, all payments become final and non-refundable. Projects that have gone live may not be cancelled or refunded due to the time, labor, customization, and development services already completed.
Ownership of Website
All website designs, graphics, layouts, content formatting, and development work remain the property of Gorham's Web Creations until full payment has been received.
Non-Payment
If payment is not completed, Gorham's Web Creations reserves the right to suspend, remove, disable, or withhold the website and related services until the account balance is paid in full.
Client Responsibilities
Clients are responsible for providing accurate business information, logos, images, text, and requested updates in a timely manner. Delays in communication may delay project completion timelines.
Website Maintenance
Unless otherwise agreed in writing, ongoing maintenance, updates, hosting fees, domain fees, SEO services, future edits, or technical support are not included in the initial website design price.
Search Engine Rankings
While SEO best practices may be used, Gorham's Web Creations does not guarantee first-page Google rankings, increased sales, lead generation results, or specific business outcomes due to search engine algorithm changes and market competition.
Third-Party Services
Gorham's Web Creations is not responsible for outages, pricing changes, technical issues, or failures caused by third-party services including hosting providers, domain registrars, payment processors, booking software, or external platforms.
Cancellation
Either party may cancel a project before the website is published live. Any completed work, design time, or development services performed before cancellation may still require partial payment.
Limitation of Liability
Gorham's Web Creations shall not be held liable for lost profits, business interruptions, data loss, downtime, hacking, or damages resulting from website issues, technical failures, or third-party service providers.
Approval of Work
Once the client approves the website design, requests publication, or submits payment to launch the website live, the project will be considered accepted and substantially completed.
Modifications to Terms
Gorham's Web Creations reserves the right to update or modify these terms and conditions at any time.
